PRIVACY PROTECTION

We respect our customers' right to privacy. We do not disclose any personal information about our customers to third parties, except as specified in our Privacy Policy. Shipping and billing addresses must be valid and located within Canada; P.O. boxes are not accepted. You must also provide your phone number and email address so that our Customer Contact Center can reach you regarding your order.

SALES TAXES

Products on SHOESS.CA are taxable, just as they are in-store. Sales taxes are calculated based on applicable federal and provincial laws and the rates associated with your order. Where required by law, shipping fees are also taxable. In the event of a refund, we will also refund the amount of taxes paid. Taxes paid on shipping fees are non-refundable. Shipping fees themselves are also non-refundable, unless the return is due to a shipping error on our part.


TERMS AND CONDITIONS OF SALE

This agreement (the "Agreement") sets forth the terms and conditions that apply to the purchase of products and/or services (the "Products") from SKECHERS QUEBEC - ATLANTIC CANADA ("SHOESS.CA") through the website www.shoess.ca. SHOESS reserves the right to modify these terms and conditions at its sole discretion and without notice. The terms "you" and "your" refer to the person purchasing products through the website.

PLEASE READ THIS AGREEMENT CAREFULLY. BY USING THIS WEBSITE TO PURCHASE PRODUCTS ONLINE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO THIS AGREEMENT.

As further explained in Section 11, and unless otherwise stated, SKECHERS QUEBEC/SHOESS.CA makes no representations or warranties regarding the products purchased through this website, and the liability of SHOESS.CA is limited in accordance with Section 11.

1. AUTHORIZATION TO USE ELECTRONIC DOCUMENTS You hereby authorize the exchange of documents and information between you and SKECHERS QUEBEC/SHOESS.CA via the Internet or email. You agree that this Agreement (along with any applicable order confirmation accepted by SKECHERS QUEBEC/SHOESS.CA) in electronic form is equivalent to an original written agreement.

2. OTHER DOCUMENTS, AGREEMENTS, AND POLICIES The use of this website is governed by separate Website Terms of Use and our Privacy Policy. In the event of any inconsistency between this Agreement and other policies, the provisions of this Agreement shall prevail.

3. ORDERING Before submitting an order, you will see an order confirmation screen detailing the products, purchase price, shipping fees, and applicable taxes. When you click "Confirm Order," you are making an offer to purchase. An order is not binding until SKECHERS QUEBEC/SHOESS.CA has accepted it via a confirmation email.

4. CANCELLATION SKECHERS QUEBEC/SHOESS.CA reserves the right to limit quantities, terminate accounts, and refuse or cancel any order, even after it has been confirmed and charged. If an order is canceled after payment, you will be issued a full refund.

5. PRICES All prices are in Canadian dollars. While we strive for accuracy, errors may occur. SKECHERS QUEBEC/SHOESS.CA reserves the right to correct prices and information at any time without notice. If a price is incorrect, we will cancel the order and invite you to place a new one at the correct price.

6. PAYMENT TERMS Payment shall be made by credit card unless another predetermined method is accepted. All credit card payments are subject to approval by the issuing financial institution.

7. PRODUCT AVAILABILITY Availability may be limited. If a product is unavailable, we will notify you by email and that part of your order will be canceled. Products sold on SHOESS.CA are intended for delivery within Canada only.

8. SHIPPING FEES AND TAXES Shipping is arranged according to your chosen method and the address provided. Delivery dates are estimates. SHOESS.CA is not responsible for damages resulting from delivery delays. Shipping and handling fees, as well as taxes, are billed separately.

9. OWNERSHIP; RISK OF LOSS Products are delivered by a third-party carrier. SHOESS.CA is not responsible for delivery delays or failures beyond its control but will make every effort to ensure a smooth delivery process.

10. RETURNS Returned products are subject to the SHOESS.CA Return Policy, the terms of which are incorporated herein by reference.

11. EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY EXCEPT AS EXPRESSLY STATED, SHOESS.CA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE. SHOESS.CA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCTS SUBJECT TO THE CLAIM.

12. GOVERNING LAW This Agreement shall be interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.

13. DISPUTE RESOLUTION – INJUNCTION (Note: This section may not apply to residents of Quebec or Ontario where prohibited by consumer protection laws). Disputes shall be resolved through binding arbitration rather than in court. No claim may be joined with another person's claim or resolved through a class action.

14. EXPORT LAWS Products are subject to Canadian export control laws and regulations.

15. HEADINGS Headings are included for convenience only and do not affect the interpretation of this Agreement.

16. ASSIGNMENT You may not assign your rights under this Agreement without express written consent.

17. ENFORCEMENT This Agreement is binding upon and inures to the benefit of the parties and their respective successors and assigns.

18. SEVERABILITY If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between you and SKECHERS QUEBEC/SHOESS.CA regarding the subject matter herein.

20. NO WAIVER Failure to enforce any provision does not constitute a waiver of the right to do so in the future.
